The vast majority has used the brief formula of swearing or promising the Magna Carta, except for the PNV MEP Ohiane Agirregoitia (Coalition for a Solidarity Europe), the EH Bildu candidate and former member of ETA Penando Barrena (Now Republics), who have done "by legal imperative", as did the representative of the BNG Ana Miranda (Now Republics). The three parliamentarians from Sumar, led by Estrella Galán, have chosen to promise, where appropriate, "for social justice and human rights"; Jaume Asens, has done it "for the Europe of the people" and Vicent Marzà "for the Valencian people and social justice." At the beginning of the event, the MEP of Ahora Repúblicas, Diana Riba (ERC) asked if it was mandatory to abide by the Constitution to be a MEP, or optional, as indicated by the Court of Justice of the European Union, to which the president of the Board Central Electoral (JEC), Segundo Menéndez, has responded that it continues to be mandatory under article 224 of the electoral law and according to the criteria of the Supreme Court. Faced with this scenario, Diana Riba has presented an appeal to the JEC in which she has criticized this procedure and has asked to end its obligation: «Once again we see how the Spanish judges set limits and want to impose procedures that are not at all within of European regulations. In a subsequent press conference, Riba recalled that the European courts have already ruled on this type of practices and have concluded that no Member State can deny the status of MEP by putting in "more formalities" and therefore, the Spanish representatives of the Parliament European Union would not have to abide by the Constitution. For his part, from the JEC, President Miguel Colmenero has reminded Riba that this ruling to which the Catalan leader has referred does not invalidate the provisions of the Spanish Electoral Law and that, in fact, the Supreme Court has continued to demand that procedure after that European decision.
