{"id":96792,"date":"2024-10-09T06:06:09","date_gmt":"2024-10-09T04:06:09","guid":{"rendered":"https:\/\/thediplomatinspain.com\/?p=96792"},"modified":"2024-10-08T19:26:17","modified_gmt":"2024-10-08T17:26:17","slug":"picardo-assures-before-un-that-spain-builds-its-position-on-resolutions-from-fascist-period","status":"publish","type":"post","link":"https:\/\/thediplomatinspain.com\/en\/2024\/10\/09\/picardo-assures-before-un-that-spain-builds-its-position-on-resolutions-from-fascist-period\/","title":{"rendered":"Picardo assures before UN that Spain builds its position on resolutions from \u201cfascist\u201d period"},"content":{"rendered":"<h6><strong>Eduardo Gonz\u00e1lez<\/strong><\/h6>\n<h4><strong>The Chief Minister of Gibraltar, Fabi\u00e1n Picardo, has assured the UN that the resolutions of the United Nations General Assembly on which Spain bases its claims of sovereignty over the Rock lack a \u201clegal value\u201d and were adopted \u201cwhen Spain was still in dictatorship and Gibraltar was the only representative democracy on the Iberian Peninsula\u201d.<\/strong><\/h4>\n<p>\u201cEvery year we hear the Spanish representative tell you the same thing,\u201d Picardo told the Special Political and Decolonization Committee (the so-called Fourth Committee) of the 79th Session of the UN General Assembly on Monday. \u201cThey talk about resolutions of the General Assembly, adopted more than half a century ago, which they say support their sovereignty claim over our homeland,\u201d he continued.<\/p>\n<p>According to Picardo, \u201cSpain ceded sovereignty over Gibraltar, in perpetuity, in 1713\u201d and \u201cno resolution of the General Assembly can change that fact.\u201d \u201cNor can it curtail our inalienable right of self-determination,\u201d he added.<\/p>\n<p>\u201cIn fact, there is no legal value in the General Assembly resolutions that Spain relies on, they are legally worthless\u201d because \u201cthey are not declaratory of any principle of international law,\u201d and \u201cthere is nothing in those resolutions that trumps the resolution that really matters,\u201d the Chief Minister said.<\/p>\n<p>\u201cThat is General Assembly Resolution 1514 (XV) which explicitly declared the existence of the right of self-determination,\u201d he said. \u201cThis is the very right that underpins the historic agreement reached last week between the United Kingdom and Mauritius, completing Mauritius\u2019 decolonisation. It restores its territorial integrity and allows for the return to the Chagos Archipelago of its exiled inhabitants,\u201d he said, referring to the recent decision by the United Kingdom to cede sovereignty of the Chagos Islands to Mauritius, a territory that has no resident population because its inhabitants were evicted by the British Government in the 1960s to install a military base.<\/p>\n<p>On the other hand, Picardo warned, \u201cit is undoubtedly embarrassing for the existing, socialist, progressive Government of modern Spain to have to rely on Resolutions obtained here by what even they describe as the fascist Government of 1960s Spain\u00a1.\u201d \u201cI remind the Committee that the last resolution voted on was in 1969, when Spain was still in dictatorship and Gibraltar was the only representative democracy on the Iberian Peninsula,\u201d he said.<\/p>\n<p>\u201cApart from having no legal value, that resolution had limited political weight, even 50 years ago \u2013 because nearly half of the United Nations\u2019 membership at the time either voted against it, abstained, or did not vote\u201d and, therefore, \u201cin international law and politically, reliance on those resolutions is flawed and futile,\u201d because \u201cGibraltar cannot legally be decolonised by adherence to those stale and legally worthless resolutions, let alone by integration into Spain,\u201d warned Picardo. \u201cIn fact, such an action would not amount to decolonisation \u2013 it would result in the recolonisation of Gibraltar, but by a different colonial power,\u201d the Chief Minister asserted.<\/p>\n<h5><strong>\u201cThe ball is now in Spain\u2019s court\u201d<\/strong><\/h5>\n<p>On the other hand, Picardo used his speech to urge Spain to accept \u201cimaginative and balanced solutions\u201d in the current negotiations on Gibraltar\u2019s future membership in the EU after Brexit, taking into account \u201cthe best interest of all people in Gibraltar and the region\u201d and respecting \u201cthe systems and security of the Schengen Area and the integrity of the Single Market\u201d. \u201cThe ball is, therefore, very much now in Spain\u2019s Court. Because any solution must also respect my people\u2019s position on sovereignty, jurisdiction and control\u201d, he said.<\/p>\n<p>According to the Chief Minister, all parties involved in the negotiations are \u201cworking well together\u201d in the search for \u201can area of \u200b\u200bshared prosperity\u201d in Campo de Gibraltar \u201cthat delivers mutual economic benefit\u201d. \u201cJust last month I attended, alongside the British Foreign Secretary, the Rt Honourable David Lammy MP, the third meeting in Brussels with the Vice President of the European Commission, Maros Sefcovic, as well as a delegation from the Spanish Foreign Ministry led by Minister Albares\u201d, he recalled. It was \u201csocialist politicians meeting with a chance to show how we can resolve people\u2019s problems, not exacerbate them\u201d, he
