{"id":95362,"date":"2024-09-27T06:03:27","date_gmt":"2024-09-27T04:03:27","guid":{"rendered":"https:\/\/thediplomatinspain.com\/?p=95362"},"modified":"2024-09-26T20:40:36","modified_gmt":"2024-09-26T18:40:36","slug":"the-european-court-of-justice-rejects-puigdemonts-appeal-on-his-mep-seat","status":"publish","type":"post","link":"https:\/\/thediplomatinspain.com\/en\/2024\/09\/27\/the-european-court-of-justice-rejects-puigdemonts-appeal-on-his-mep-seat\/","title":{"rendered":"The European Court of Justice rejects Puigdemont&#8217;s appeal on his MEP seat"},"content":{"rendered":"<h6><strong>Asier Mart\u00ednez Jurio-Aqu\u00ed Europa<\/strong><\/h6>\n<p><strong>The Court of Justice of the European Union (CJEU) has definitively annulled the appeal filed by former Catalan president Carles Puigdemont and former minister Toni Com\u00edn in relation to the refusal of the then president of the European Parliament, Antonio Tajani, to recognize their status as MEPs in June 2019.<\/strong><\/p>\n<p>According to the CJEU, contrary to what Puigdemont and Com\u00edn claimed, it is true that the president of the European Parliament cannot ignore the list of candidates sent by the member country. In addition, the judges affirm that this list can only be presented by the corresponding Spanish courts.<\/p>\n<p>\u201cThe president of the Parliament limited himself to doing what he was obliged to do: take note of the list of elected deputies notified by the Spanish authorities,\u201d confirms the CJEU. Tajani claimed that their names did not appear on the list of elected candidates notified by the Spanish authorities.<\/p>\n<p>Tajani&#8217;s successor, David Sassoli, did recognise them as MEPs following another ruling by the CJEU on Oriol Junqueras. However, in the current legislature, President Roberta Metsola has again refused to elect them for the same reasons as Tajani and they have again submitted to the ruling by the CJEU.<\/p>\n<p>\u201cIndeed, the President of Parliament has no power to control the accuracy of this list, under penalty of violating the distribution of powers between the Union and the Member States. Such control is the exclusive responsibility of the national courts,\u201d the document states.<\/p>\n<p>\u201cThe President of Parliament merely did what he was obliged to do: take note of the list of elected deputies notified by the Spanish authorities, which for him constituted a pre-existing situation derived from decisions that had been taken at national level,\u201d it adds.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Tribunal de Justicia de la Uni\u00f3n Europea (TJUE) ha anulado de forma definitiva el recurso presentado por el expresidente catal\u00e1n Carles Puigdemont y el exconseller Toni Com\u00edn en relaci\u00f3n a la negativa del entonces presidente del Parlamento Europeo, Antonio Tajani, a reconocerles su condici\u00f3n de eurodiputados en junio de 2019.
