The European Commission has issued an ultimatum to Spain for failing to transpose a law to prevent taxpayers<\/strong> from taking advantage of differences between EU countries’ tax systems, as part of the anti-tax avoidance directive, reports Europa Press<\/em>.<\/p>\n

 <\/p>\n

The EU executive has initiated the second phase of the procedure by sending a reasoned opinion to the Spanish authorities and Greece for not communicating the national measures implemented on the reverse hybrid mismatches included in the directive.<\/p>\n

 <\/p>\n

Specifically, the rule prevents taxpayers from taking advantage of differences between tax systems to pay less or no tax and avoid damaging the tax base of Member States.<\/p>\n

 <\/p>\n

Both countries had until 31 December 2021 to communicate the implementation of the rule. Spain and Greece now have two months to respond to Brussels, which could ultimately take the matter to the European Court of Justice if the authorities do not correct the situation.<\/p>\n
