The Centre for Innovation in Law is organising next Monday, 27 June, at 12 noon, the presentation of the book La Modernisation du Droit Haïtien – Un Défi Pour L’avenir (The Modernisation of Haitian Law – A Challenge for the Future), written by Dr. Josué Pierre-Louis. The event will be presented by Professor Antonio Alonso Timón, Director of the Centre for Innovation in Law (CID-ICADE) and will take place in the Aula P. Martín De Nicolas (E-308) Faculty of Law – Icade. Comillas Pontifical University-Icade.

 

After its independence, the Republic of Haiti was inspired by the French model to build its legal system. However, if from an institutional and legal point of view the reception of the civil law model seems perfect, the anthropological analysis of the modalities of application of this system underlines that this reception is so limited that most of the legal life is still regulated according to an endogenous vision of society. Hence the divorce between the planning action of the legislator and the administrator and the forms of conflict management in the day-to-day life of citizens. Moreover, if institutional schemes seem inadequate to respond to people’s demands for justice and access to the law, the various informal and customary responses illustrate the need for a state with strong institutions. This book postulates the creation of a new law that not only involves the complementarity between institutional logic and other community logics, but also takes into account the international instruments ratified by Haiti in a context of regional integration, which is increasingly necessary in the face of the challenges of the globalisation of law.
