The extradition agreement between Spain and Jordan will enter into force on May 17th

Eduardo González The Extradition Agreement between the Kingdom of Spain and the Hashemite Kingdom of Jordan, signed in Madrid in June 2025 during King Abdullah II's working visit to Spain, will enter into force on May 17th. "The Extradition Agreement between the Kingdom of Spain and the Hashemite Kingdom of Jordan is the result of both countries' desire to strengthen their ties and regulate relations in the area of extradition, which until its entry into force had been governed by the principle of international reciprocity," the Council of Ministers stated in September 2025, after approving the submission of the text to the Spanish Parliament. The agreement, once authorized by the Council of Ministers at its meeting on January 14, 2025, was signed in Madrid on June 5, 2025, by the Minister of Foreign Affairs, José Manuel Albares Bueno, and the Deputy Prime Minister and Minister of Foreign Affairs and Expatriates of Jordan, Ayman Safadi. The signing took place during King Abdullah II's working visit to Spain, where he was received by King Felipe VI and the Prime Minister, Pedro Sánchez. During that visit, both governments also adopted the Strategic Partnership Agreement, which elevates the bilateral relationship to the highest possible level. According to this agreement, as published last week in the Official State Gazette (BOE), the parties agree to mutually extradite individuals located in their territory who are wanted by the other party for trial or for the execution of a sentence imposed by the courts of that party for extraditable offenses. Extradition will only be granted for offenses defined as crimes under the laws of both parties. Furthermore, if extradition is requested to prosecute a person for a crime, the corresponding prison sentence must be longer than one year according to the laws of both parties. Additionally, if extradition is requested to execute a custodial sentence, the convicted person must have at least six months of that sentence remaining to be served at the time of the request. Extradition will be denied when the requested party considers the offense for which extradition is requested to be political in nature. For these purposes, the following will not be considered political offenses: attacks or attempted attacks against the life or physical integrity of the King of Spain, the King of Jordan, their regents, or members of their families; nor will they consider acts of terrorism. Extradition will also be denied when the requested party has justifiable grounds to believe that the extradition request has been submitted for the purpose of persecuting or punishing the person sought based on race, sex, religion, nationality, or political opinions. Extradition will also be denied when the offense for which extradition is requested is purely military in nature, the person sought is a national of the requested party, the requested party has granted the person sought political asylum, or the offenses or penalties have expired under the law of either party. Nor will extradition be granted when the courts of the requested party have already issued a final judgment or concluded legal proceedings against the person sought for the offense for which extradition is requested, or when the person sought has already been tried for that offense in a third state, acquitted, or served the corresponding sentence. Extradition will also be refused when the requesting party seeks extradition on account of a sentence imposed in absentia, unless that party provides sufficient legal guarantees that there will be a new trial, or when the offense for which extradition is sought is punishable by death under the legislation of the requesting party, unless that party provides guarantees, considered sufficient by the requested party, that such a sentence will not be imposed or, if imposed, will not be carried out.
