<h6><strong>The Diplomat</strong></h6> <h4><strong>46% of the laws approved by the Cortes Generales (Spanish Parliament) in Spain in 2024 originate from the European institutions, according to the report published annually by the Office of the European Parliament in Spain. The document also shows that Spain is pending to transpose 87 European directives, 29 of which have already met their transposition deadline.</strong></h4> In 2024, according to the report, the Congress of Deputies and the Senate approved a total of 24 laws. Of these, eleven regulations regulate aspects that respect the line marked by the institutions of the European Union, that is, they derive from community directives or regulations or are framed within the regulatory umbrella established by the European institutions. Of these eleven regulations of European origin, five transpose European directives into the Spanish legal system or adapt or develop aspects of European regulations. These are the Directives on family and professional conciliation, equal representation of women and men in listed companies, exchange of information on criminal records and the consideration of judicial decisions in the European Union, the application of a tax on multinationals or the European regulation that establishes a single market for digital services (DSA Regulation). The other six laws approved in 2024 contain references or are based on European provisions, that is, they respect the line set by the institutions of the European Union, although they do not directly respond to a transposition mandate. <strong>Stable figure in five years</strong> In this first year of the 15th legislature, although slightly down, the levels of influence of the decisions adopted in the European Union remain the same as in the previous legislature, the report continues. Over the previous five years, the weight of European decisions was reflected in 53% of the regulations adopted in Spain, including those that included the transposition of the Directive on the impact of plastics, the one on tax cooperation in the EU, the one on Audiovisual Communication Services or the one on the single railway area for the EU. <strong>Transpositions in regulations without the rank of law</strong> Another 20 regulations approved by the Council of Ministers in 2024 also transpose European directives or have been adapted to regulations. These are Royal Decrees that, being regulations without the rank of law, do not require following a parliamentary procedure in the Cortes. Most of them transpose directives related to the Common Agricultural Policy or Fisheries and, to a lesser extent, to transport, health or working conditions. Notable among them are the Royal Decree establishing a new format of safe-conduct pass based on the provisional EU travel document, the one that increases the protection of workers against exposure to carcinogenic agents in the workplace, the one that approves the Statute of the Independent Authority for the Protection of Informants to protect people who report irregularities within public or private organisations or the one that includes the rules for entry, residence and work in Spain for temporary workers, highly qualified workers, researchers, students on internships and nationals of third countries. <strong>87 directives pending transposition</strong> As of today, according to data from December 2024 from the Ministry of Foreign Affairs, Spain is pending the transposition of 87 European directives, most of them with a transposition deadline in 2024, 2025 and 2026. Of these, 29 have already met their transposition deadline. Among the directives approved in 2024 are the air quality directive, which establishes stricter limits on the emission of pollutants into the atmosphere, the directive that strengthens the fight against human trafficking, including new forms of exploitation, such as surrogacy, illegal adoption and forced marriage; or the one that, for the first time, establishes a supranational framework to combat violence against women and domestic violence throughout the EU. <strong>84 regulations directly applicable in Spain</strong> In addition, in 2024, 84 European regulations have been approved that are directly applicable in all Member States and, therefore, are already part of the set of Spanish laws. These include the regulation that prohibits products made with forced labor in member countries, the one that establishes common data registration standards for tourist rentals in the EU, or the one that approves the first regulatory framework for the use of Artificial Intelligence in the EU. El documento muestra también que</strong> <strong>España está pendiente de transponer 87 directivas europeas, 29 de las cuales ya han cumplido su plazo de transposición.</strong> En 2024, según el informe, el Congreso de los Diputados y el Senado aprobaron un total de 24 leyes. De ellas, once normativas regulan aspectos que respetan la línea marcada por las instituciones de la Unión Europea, es decir, derivan de directivas o reglamentos comunitarios o se enmarcan en el paraguas regulatorio fijado por las instituciones europeas. De esas once normativas con origen europeo, cinco trasponen directivas europeas al ordenamiento jurídico de España o bien se adaptan o desarrollan aspectos de reglamentos europeos. Se trata de las Directivas sobre conciliación familiar y profesional, representación paritaria de mujeres y hombres en sociedades cotizadas, intercambio de información sobre antecedentes penales y la consideración de resoluciones judiciales en la Unión Europea, la aplicación de un impuesto a multinacionales o el reglamento europeo que establece un mercado único de servicios digitales (Reglamento DSA). Las otras seis leyes aprobadas este 2024 contienen referencias o se basan en disposiciones europeas, es decir, respetan la línea marcada por las instituciones de la Unión Europea, aunque no respondan directamente a un mandato de transposición. <strong>Cifra estable en cinco años</strong> En este primer año de la XV legislatura, aunque levemente a la baja, los niveles de influencia de las decisiones adoptadas en la Unión Europea se mantienen respecto a la legislatura anterior, prosigue el informe. Durante los cinco años anteriores, el peso de las decisiones europeas se reflejó en el 53% de las normas adoptadas en España, entre ellas las que incluían la transposición de la Directiva sobre el impacto de plásticos, la de cooperación fiscal en la UE, la de Servicios de Comunicación Audiovisual o la del espacio ferroviario único para la UE. <strong>Transposiciones en normas sin rango de ley</strong> Otras 20 normativas aprobadas por el Consejo de Ministros en 2024 transponen también directivas europeas o se han adaptado a reglamentos. Se trata de Reales Decretos que, al ser normas sin rango de ley, no requieren seguir un procedimiento parlamentario en las Cortes. En su mayoría transponen directivas relacionadas con la Política Agrícola Común o Pesca y, en menor medida, con el transporte, la salud o las condiciones laborales. Destacan entre ellas, el Real Decreto que establece un nuevo formato de salvoconducto basado en el documento provisional de viaje de la UE, el que aumenta la protección de los y las trabajadores frente a la exposición a agentes cancerígenos en el ámbito laboral, el que aprueba el Estatuto de la Autoridad Independiente de Protección del Informante para proteger a las personas que denuncian irregularidades dentro de organizaciones públicas o privadas o el que recoge las normas de entrada, residencia y trabajo en España para trabajadores temporeros, de alta cualificación, investigadores, estudiantes en prácticas y nacionales de terceros países. <strong>87 directivas pendientes de trasponer</strong> A fecha de hoy, según datos de diciembre de 2024 del Ministerio de Asuntos Exteriores, España está pendiente de transponer 87 directivas europeas, la mayoría de ellas con fecha límite de transposición en 2024, 2025 y 2026. De ellas, 29 ya han cumplido su plazo de transposición. Entre las directivas aprobadas en 2024 figuran la de calidad de aire, que establece límites más estrictos a la emisión de contaminantes a la atmósfera, la directiva que refuerza la lucha contra la trata de personas, incluyendo nuevas modalidades de explotación, como la maternidad subrogada, la adopción ilegal y el matrimonio forzado; o la que, por primera vez, establece un marco supranacional para combatir la violencia contra las mujeres y la violencia doméstica en toda la UE. <strong>84 reglamentos directamente aplicables en España</strong> Además, en 2024, se han aprobado 84 reglamentos europeos que son de directa aplicación en todos los Estados miembros y, por tanto, ya forman parte del conjunto de leyes españolas. Entre ellos, figuran el reglamento que prohíbe los productos realizados con trabajos forzosos en los países miembros, el que establece normas comunes de registro de datos para alquileres turísticos en la UE, o el que aprueba el primer marco normativo para el uso de Inteligencia Artificial en la UE.
