Section 5 of the Administrative Chamber of the Audiencia Nacional has requested “as a matter of urgency” the Ministry of the Interior to send “the file accompanied by the reports and data it deems appropriate” regarding the repatriation of unaccompanied minors to Morocco within five days.
The period begins to run from the moment of notification, which in this case, according to sources consulted, was yesterday, as reported by Europa Press. In a memorandum of organisation dated 16 August, the Court indicates that when the administrative body – the Interior – sends this file, it must notify all those who appear as interested parties in it, “attaching a copy of the writ of interposition and summoning them so that they can appear as defendants before this Section within five days”.
It recalls that both the department of Fernando Grande-Marlaska and the rest of the defendants, once the file has been sent, may request the inadmissibility of the appeal presented by the Spanish Network for Immigration and Refugee Aid and the holding of the hearing in accordance with article 117.2. In addition, the court informs that a separate section will be opened on the request for the adoption of precautionary measures.
