National Court acquits Guatemalan ex-minister accused of crimes against humanity

The Diplomat. 16/03/2017

The National Court yesterday acquitted former minister of the Interior of Guatemala between 2004 and 2007, Carlos Vielmann, tried for having authorized the execution of ten prisoners who had escaped or mutinied in two prisons of that country in the years 2005 and 2006.

The Prosecutor’s Office requested a sentence of 160 years in prison for eight murder offenses and 300,000 euros compensation for each of the deceased, while the private and popular prosecution called for a 300-year sentence for ten crimes against humanity.

In its proven facts, the judgment of the Second Section of the Criminal Chamber, with a speech by Judge Juan Pablo González and which has a particular vote, considers, in relation to the escape of the maximum security prison of ‘El Infiernito’ In October 2005, that it was not established that the defendant Carlos Vielmann was aware of the actual circumstances in which the capture and death of the prisoners who had been fleeed occurred, beyond the reports of such events being received by the official channels.
