The Spanish Government announced yesterday the filing of an appeal against the reopening of the Catalan ‘embassies’ in the United Kingdom and Ireland, Germany, the USA, Italy, Switzerland and France, which had been closed during the application of article 155 of the Constitution, according to a note from the Ministry of Foreign Affairs.
The note indicates that the Ministry itself will be in charge of presenting the appeal against Decree 126/2018 of the Generalitat of Catalonia, of June 26, whereby the aforementioned delegations of the Government of the Generalitat are reinstated. The Government considers that the reopening has been carried out in contravention of Article 12 of the Law of Action and of the Foreign Service of the State, which establishes that before the creation of their delegations abroad for the exercise of their powers, the Autonomous Communities must communicate it to the Government of Spain.
With this provision, it is intended that the Ministry can report on the adequacy of the proposal to the guidelines, purposes and objectives of the Foreign Policy, the Strategy of External Action and, in particular, with the principle of unity of action abroad, as well as for the Ministry of Finance to issue a report regarding the principle of efficiency in the management of public resources, and the Ministry of Territorial Policy and Public Function may do so from the perspective of its adaptation to the jurisdictional order.
However, adds the Foreign Ministry, the Generalitat informed the creation of these delegations only 24 hours before the adoption of the decree, which made it impossible to issue such reports.

The Generalitat, which argues that these are not new delegations but just to reopen existing ones, had not informed the Government of Rajoy when created them, so the Executive also presented contentious-administrative appeals. These were archived when the closing of the delegations took place.
Along July, the Generalitat restored the delegates in the United Kingdom and Ireland, Germany, Italy and Switzerland.
