The Supreme Court has condemned the Spanish State for partially failing to fulfill its obligation to process the asylum applications of refugees from Greece and Italy established in 2015 by the European Council, according to which it was assigned a quota of 19,449 people for two years, from September 25 until September 26, 2017, of which it only offered 12.85%.
The court considers that the unfulfilled community decisions were “of binding and compulsory character”, so not complying with them entails “the condemnation of the Spanish State to continue the processing in the terms included in the decisions and according to the agreements henceforth adopted by the community institutions”.
